IHBC Toolbox latest Guidance Note: Using S.19 on amendments to LBC

The IHBC’s latest Guidance Note on our Toolbox, produced in consultation with the institute’s Legal Panel, provides advice on the application of Section 19 (S.19) of the 1990 Planning (LBCA) Act in relation to the amendment of conditions attached to a Listed Building Consent.

IHBC Legal Panel convenor and guidance note author – and IHBC Vice Chair – Lone Le Vay said: ‘This new Guidance Note provides useful clarification on when it is appropriate to use S.19 of the Planning (Listed Buildings and Conservation Areas) Act 1990, when changes are proposed to approved alterations to a Listed Building. The guidance note is particularly relevant to conditions requiring adherence to approved drawings and confirms the legal position that only the written description is fundamental to a consent.’

‘If a condition attached to a consent requires adherence to approved drawings, then it’s the wording that contains the condition, not the drawing to which S.19 refers. This stresses the importance of ensuring that the published description of the works that are to be approved in being clear as to the size (as well as the number of storeys) and materials where relevant.’
